Welcome to PetStudio. By downloading, accessing, or using our mobile application and related services, you agree to be bound by these Terms of Service. Please read them carefully before using our services.

PetStudio is operated by ArtArray Global LLC, 15442 Ventura Blvd, Ste 201-1072, Sherman Oaks, CA 91403, United States.

1. Acceptance of Terms

By accessing or using PetStudio's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Services Description

PetStudio provides an AI-powered mobile application that transforms pet photos into artistic portraits. Users can generate AI artwork from their pet photos using various art styles, and order custom-printed products including canvas prints, framed prints, metal prints, posters, mugs, and phone cases. All physical products are made to order and produced by our fulfillment partners.

3. User Accounts

To access certain features and place orders, you may need to create an account or sign in with Apple/Google. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized use of your account

3.1 Account Restrictions and Termination

PetStudio reserves the right to limit, suspend, or terminate any customer account at our sole discretion. We may take these actions for customers who:

• Have excessive refund requests (more than 3 refunds in any 12-month period)
• Show patterns consistent with fraud, abuse, or exploitation of our policies
• Provide false or misleading information in refund or dispute claims
• Engage in chargeback abuse (filing chargebacks without first contacting us)
• Use multiple accounts to circumvent limits or restrictions
• Engage in any activity that harms PetStudio, our partners, or other customers

No refund or compensation is owed to customers whose accounts are terminated for abuse or violation of these Terms.

4. Subscriptions & In-App Purchases

PetStudio offers subscription plans and one-time in-app purchases:

• Free Tier: Includes 3 lifetime AI generations at no cost
• Premium Subscription: Monthly ($4.99/month) or annual ($29.99/year) plans with enhanced features and generation limits

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Renewal charges are processed through Apple's App Store using your Apple ID payment method.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a subscription period.

Free Trial

If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends. Apple manages all subscription billing.

5. AI-Generated Content

PetStudio uses artificial intelligence to generate artistic portraits from your pet photos. By using our AI generation features, you acknowledge and agree that:

• AI-generated portraits are provided "as-is" and results may vary based on input photo quality, lighting, angle, and other factors
• We do not guarantee that generated artwork will match your exact expectations or vision
• Generated images are artistic interpretations and may not be photorealistic representations of your pet
• Free generation credits are non-refundable and cannot be exchanged for monetary value
• We reserve the right to modify, improve, or change AI models and styles at any time

Ownership: You retain ownership of your original pet photos. Generated artwork is licensed to you for personal and commercial use upon creation. PetStudio retains the right to use anonymized, non-identifiable generated artwork for service improvement and marketing purposes.

6. Intellectual Property Rights

Our Content

All content in PetStudio, including art styles, UI design, text, graphics, logos, and software, is owned by PetStudio (ArtArray Global LLC) or our content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express permission.

Your Content

When you upload photos to our platform, you represent that:

• You own or have the right to use the photos
• The content does not infringe on any third-party rights
• The content does not violate any laws or regulations

You grant PetStudio a non-exclusive license to use your uploaded photos for the purpose of generating artwork and fulfilling your orders.

7. Orders and Payments

When you place an order for physical products:

• You are making an offer to purchase the products
• We reserve the right to accept or reject your order
• Payment for physical products is processed through Stripe (cards, Apple Pay, Google Pay)
• Prices are subject to change without notice
• You are responsible for all applicable taxes, duties, and shipping fees

9. Production and Shipping

• Products are made to order (production time: 2-7 business days)
• Shipping times vary by location (standard: 5-12 business days)
• Express shipping options are available at checkout
• We are not responsible for delays caused by customs or carriers
• Risk of loss transfers to you upon delivery to the carrier

9.1 International Shipping and Customs

For international orders:

• You are responsible for all customs duties, import taxes, and fees imposed by your country
• We are not responsible for packages delayed, returned, or seized by customs
• Customs fees are non-refundable, even if you refuse delivery

9.2 Force Majeure

PetStudio shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, pandemics, labor disputes, carrier failures, or infrastructure outages. In such events, we will make reasonable efforts to fulfill your order but reserve the right to cancel orders with full refunds if fulfillment becomes impossible.

10. Product Quality Disclaimer

Due to the print-on-demand nature of our products, please note:

• Colors may vary slightly from digital previews due to monitor calibration and printing processes
• Print placement and size may vary slightly between products
• Product mockups in the app are digital representations, not photographs of actual products
• Minor variations are inherent to print-on-demand manufacturing

Only significant defects or errors qualify for replacement or refund as described in Section 11.

11. Returns and Refunds

Important: Because our products are custom-made for each order, we do not accept returns or exchanges for:

• Change of mind
• Wrong size or product selected by customer
• Dissatisfaction with AI-generated artwork style or quality
• Minor color or placement variations inherent to printing

We will offer a replacement or refund if:

• The product arrives damaged or defective
• There is a manufacturing error
• The wrong product was sent

To request a replacement or refund, contact us within 30 days of delivery with photo evidence at hello@getpetstudio.com.

12. Prohibited Uses

You may not use our services to:

• Upload content that infringes on intellectual property rights
• Upload photos of humans or non-pet subjects for generation
• Use offensive, illegal, or inappropriate content
• Attempt to reverse-engineer our AI models or generation process
• Violate any applicable laws or regulations
• Engage in fraudulent activities
• Interfere with or disrupt our services
• Scrape, crawl, or extract data from our app or API

13. Copyright Infringement & DMCA Policy

PetStudio respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on our platform infringes your copyright, please provide our Copyright Agent with:

• Physical or electronic signature of the copyright owner
• Description of the copyrighted work claimed to be infringed
• Location of the allegedly infringing material on our platform
• Your contact information
• A good faith belief statement that the use is not authorized
• A statement under penalty of perjury that the information is accurate

14. Limitation of Liability

To the fullest extent permitted by law:

• PetStudio shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the specific product or subscription period
• We do not guarantee uninterrupted or error-free service
• We are not liable for AI generation results that do not meet expectations

Third-Party Service Providers

PetStudio acts as an intermediary platform. Product manufacturing is performed by independent fulfillment partners (including Printify), AI processing by third-party providers, and payment processing by Stripe and Apple. We are not liable for acts, omissions, or negligence of third-party service providers.

15. Disclaimer of Warranties

Our services, AI-generated content, and products are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, secure, or error-free, or that AI-generated results will meet your specific expectations.

16. Indemnification

You agree to indemnify and hold harmless PetStudio (ArtArray Global LLC) and its affiliates from any claims, damages, losses, and expenses (including legal fees) arising from your use of our services, violation of these terms, or infringement of any third-party rights.

17. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.

19. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of PetStudio after changes constitutes acceptance of the modified terms. For material changes, we will provide notice through the app.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
